Terms of Service
Last updated 8 September 2026
These terms cover your use of Kelam, operated by Nousdata Inc. They describe what the service does, what you are responsible for when your agent picks up a phone, and how the service is priced. Where we have not yet decided something, this page says so rather than guessing.
01Who these terms are with
Kelam ("Kelam", "we", "us") is a product of NOUSDATA INC., a corporation registered
in the State of Illinois, United States, with its registered office in Naperville, IL and
its operations in San Francisco, CA. More
about the company is at kelam.sh/about. "You" means whoever uses the
service — a person with a workspace, or an autonomous agent buying calls at
call.kelam.sh. Using the service means these terms apply to you.
02What the service is
Kelam lets you build agents that make and answer phone calls and text messages. You define an agent, we deploy it onto telephony and voice infrastructure, and calls it places or answers are recorded, transcribed, and returned to you along with any structured fields you asked for. The behaviour of an agent follows the instructions you give it; we do not review or approve those instructions before they run.
There are two ways in. People sign in to a workspace at
app.kelam.sh. Software agents buy
calls directly at call.kelam.sh, paying per request, with no account.
03Your responsibilities on a call
A call your agent places is your call. You are responsible for it being lawful where it is placed and where it lands. That includes, without limiting it:
- Consent and disclosure. Many jurisdictions require notice before a call is recorded, and some require disclosure that the caller is automated. Meeting those requirements for your calls is your obligation, not ours.
- Calling rules. Do-not-call registries, calling-hour restrictions, and the rules on automated and unsolicited calls and texts apply to you.
- The instructions you write. An agent will do what you tell it. What you tell it is your content.
04What you may not use it for
You may not use Kelam to place, answer, or send:
- calls or messages to emergency services;
- anything unlawful, or intended to defraud, deceive for gain, or steal credentials, payment details, or identity documents;
- impersonation of a real person, business, or public body you are not authorised to speak for;
- harassment, threats, or repeated unwanted contact;
- unsolicited marketing, bulk cold-calling, or messaging to lists the recipients did not opt into;
- attempts to break, overload, or circumvent the limits of the service, or to reach another customer's workspace or data.
We may suspend an agent, a workspace, or a wallet that we reasonably believe is doing any of the above.
05Messaging
Numbers operated by Nousdata send conversational SMS and MMS only, to recipients who have opted in. The messaging program's opt-in, opt-out, frequency, and fee terms are published separately at nousdata.com/sms-terms and apply to those messages. Where those terms and these ones cover the same ground, the SMS terms govern the messaging program. If you connect your own WhatsApp Business number, Meta's terms for that platform apply to you as well.
06Fees and payment
Calls are metered on talk time, billed to the second, and capped per call. A call that nobody answers is free, and a call we fail to place is not charged. Browser calls and agent-to-agent calls carry no telephony cost. Every call stores its own provider usage and cost breakdown, so what you are billed is a recorded number rather than an estimate.
For agents buying at call.kelam.sh: each request is priced in the payment
challenge you receive before you pay, an outbound call is capped at $2.00, and the
charge settles after the call on its actual duration. Management and read routes are free.
Read current prices from that challenge, or from call.kelam.sh/llms.txt and
call.kelam.sh/openapi.json — do not hardcode a rate from this page.
07Your data
Your agent configuration, recordings, transcripts, and message history are yours. What we collect, how long we keep it, every third party in the call path, and how to have it deleted are set out in the privacy policy, which forms part of these terms. We do not use the content of your calls or messages to train foundational AI models.
08Availability
Kelam depends on third-party telephony, speech, and model providers, listed in the privacy policy. Calls can fail for reasons outside our control. We do not currently publish a service-level agreement, and nothing on this site should be read as one. If your agent's work is time-critical, build in a fallback.
09Suspension and termination
You can stop using Kelam at any time, and can ask us to delete your workspace and its data as described in the privacy policy. We may suspend or end access for a breach of section 03 or 04, for non-payment, or where we are required to.
10Changes to these terms
We may update these terms as the service changes. The new version is posted here with a new "last updated" date, and material changes are communicated to account owners. Continuing to use the service after a change means the updated terms apply.
